Bobrisky, a Nigerian transvestite who was found guilty, has filed an appeal against his sentence.
Remember that a Federal High court in Lagos found him guilty of abusing naira a few weeks ago.
On Friday, April 12, he was sentenced to six months in prison for misusing the naira, with no chance of fine.
In his appeal, the convicted transvestite asked the appellate court to overturn the six-month prison sentence that had been imposed upon him.
Bobrisky contends in the appeal, filed by his attorney Deji Adeyanju, that the trial judge committed a legal and factual error when he imposed the maximum sentence of months in jail on the appellant without offering the option of a fine, in violation of Section 416(2) d of the Administration of CriminalJustice Act of 2015 (“ADCJA”) that prescribed the mandatory guidelines on the trial court on imposition of sentencing after criminal conviction of a first time offender as the appellant.”
In light of this, the appeal “is seeking an order setting aside the six-month maximum imprisonment sentence imposed on the appellant and an imposition of a fine in the sum of N50,000 on each of the counts against the appellant in its place.”
He was charged with six charges of money laundering and naira misuse by the Economic and Financial Crimes Commission (EFCC) on Thursday, April 4.
The anti-graft agency charged Bobrisky on Friday, April 5, with six counts ranging from money laundering to currency abuse.
The EFCC had charged him with four counts of abusing the naira; however, the court dropped the money laundering accusations and found him guilty.
